General Terms and Conditions Apollanja Shopping

Article 1. Applicability

1.1 All online offers, orders and agreements of the following websites of Apollanja Shopping, all hereinafter referred to as Apollanja Shopping, are subject to these terms and conditions.

1.2 The provisions of these Terms and Conditions may only be varied in writing, in which case the remaining provisions shall remain in full force.

1.3 Accepting an offer or placing an order implies that you accept the applicability of these Terms.

Article 2. Conclusion of Agreement/Offers

2.1 All offers are subject to change without notice.

2.1 All offers by Apollanja Shopping are without obligation, offers are made subject to the availability of the products. Apollanja Shopping expressly reserves the right to change the prices when this is necessary on the basis of (legal) regulations.

2.2 A contract is concluded only when the purchaser has confirmed the order in the secure area where the address and payment details at Apollanja Shopping.

2.3 Typographical errors and mistakes when placing an order are entirely at the risk of the buyer. Apollanja Shopping is in no way liable for this (see also 5.7 & 5.8).

2.4 The invoice/order confirmation is sent immediately after the order is placed to the email address provided by the buyer. Apollanja Shopping is not liable for not receiving the invoice/order confirmation of the order.

Article 3. Prices and Payments

3.1 The prices stated for the products and services offered are in Euro only, including VAT and excluding handling and shipping costs.

3.2 Payment must be made without discount or offsetting delivery, unless otherwise agreed in writing.

3.3 Payment can be made via Ideal, prepayment to our Dutch Bank, Sofortüberweisung, Credit Card, Bancontact, Ing Homepay, PayPal or cash on collection (debit card is possible). When paying by bank, the date of payment is the date of crediting the bank account of Apollanja Shopping.

3.4 When paying in advance by Bank, the buyer has 8 days from the order date to transfer the invoice amount due for the order. If the buyer does not pay within eight (8) days, Apollanja Shopping has the right to cancel the order without notifying the buyer.

3.5 In the event of late payment, Apollanja Shopping is entitled to rescind the agreement with immediate effect or to suspend (further) delivery until such time as the Buyer has fulfilled the payment obligations in full, including payment of interest and costs due.

Article 4. Delivery time

4.1 Products ordered from Apollanja Shopping are shipped as soon as possible (Monday through Saturday). The shipping times (shipping within) given by Apollanja Shopping on the website are applied as much as possible but remain indicative. The buyer cannot derive any rights from them. The actual delivery time depends on the delivery service and country of delivery, Apollanja Shopping has no influence on this.

4.2 The delivery of the products occurs at the time the products are ready for shipment to buyer.

4.3 If the purchaser provides Apollanja Shopping with an address in writing, Apollanja Shopping will be entitled to send all orders to that address, unless the purchaser provides Apollanja Shopping with another address in writing to which the orders should be sent.

4.4 The delivery time for an order is a maximum of 30 days. Should for any reason the delivery period not be met, Apollanja Shopping will inform the buyer by telephone or e-mail. In consultation with the buyer, the delivery period may be extended.

4.5 All products are shipped only after receipt of payment for the order. In consultation with Apollanja Shopping this may be deviated from.

4.6 If the buyer chooses to pick up the order for cash payment, the buyer will be notified by phone or email on what day and time the order will be ready for pick up.

5. Complaints, liability, right of withdrawal:

5.1 Exchange and Right of Return; The buyer is obliged to carefully inspect the order (or have it inspected) immediately upon receipt. In the Netherlands there is a statutory trial period of fourteen (14) days after receipt of the order. Within this period the buyer may cancel the order without giving reasons. The buyer has the right within fourteen (14) days after notification of return to Apollanja Shopping to return the product (s). The purchase amount (including any shipping costs) will be refunded to the account number provided by the buyer. The cost of returning the order/product(s) will be borne by the buyer.

5.2 Conditions for returns:

- The product must be unused and still saleable.

- The product must be undamaged and complete and returned in its original packaging (if reasonably possible).

5.2 Excluded from returns are

- Products that have been made to the buyer's specifications or have been unequivocally customized to the buyer's personal requirements.

- Products that have been specially ordered by order of the buyer. This will be stated with the item in question.

- Any Audio or video recordings (CDs and/or DVDs) whose (plastic) packaging/sealing has been broken by the buyer.

- Any products/items/goods whose (plastic) packaging/seal has been broken by the buyer.

- Admission tickets for lectures and/or activities.

5.3 For any return, Apollanja Shopping must be notified in writing, email, whatapp or by phone by the buyer prior to shipment.

5.4 The crediting of the prepaid purchase price of the return shipments to the buyer will be made within 14 days after receipt of the order/product(s).

5.5 Apollanja Shopping will send a confirmation of each (after) delivery to the email address provided by the buyer. Apollanja Shopping is not liable for any non-receipt of this e-mail by the buyer.

5.6 If the buyer has not received the order within three (3) days after sending the products and the delivery email (see 5.5), the buyer should contact Apollanja Shopping immediately. If, after three (3) days after sending the order, the buyer reports that a delivery has not been received, Apollanja Shopping is not obliged to resend the order.

5.7 If the buyer has entered incorrect data when completing the order and Apollanja Shopping has sent the order based on these data and the order is returned to Apollanja Shopping, Apollanja Shopping will contact the buyer as soon as possible. The buyer then has the option to cancel the order. The purchase price, excluding any shipping costs paid by the buyer, will be refunded by Apollanja Shopping to the account number provided by the buyer.

If the buyer still wishes to receive the order, Apollanja Shopping may charge the additional shipping costs to be incurred in advance. Upon receipt of this payment, the order will be reshipped.

5.8 If the buyer has entered incorrect data when completing the order and Apollanja Shopping has sent the order based on these data and the order is lost or misdelivered, the buyer is not entitled to a refund of the purchase price of the order. If the buyer wishes to receive the order again, Apollanja Shopping may again charge the order in advance. Upon receipt of payment, the order will be reshipped.

Article 6. Retention of title

6.1 After full payment, the product is the property of the buyer. The risk in respect of the products already passes to Buyer at the time of delivery.

Article 7. Communication

7.1 For misunderstandings, mutilation, delays or improper transmission of orders and messages resulting from the use of Internet or any other means of communication in the traffic between purchaser and Apollanja Shopping, or between Apollanja Shopping and third parties, insofar as it relates to the relationship between purchaser and Apollanja Shopping, Apollanja Shopping is not liable, unless and insofar as there has been intent or gross negligence of Apollanja Shopping.

Such misunderstandings, mutilation, delays or improper transmission of orders and messages resulting from the use of Internet or any other means of communication between purchaser and Apollanja Shopping, or between Apollanja Shopping and third parties, insofar as it relates to the relationship between purchaser and Apollanja Shopping, Apollanja Shopping is not liable, unless and insofar as there has been intent or gross negligence of Apollanja Shopping.

Article 8. Force majeure

8.1 Without prejudice to its other rights, Apollanja Shopping has the right, in the event of force majeure, at its option, to suspend implementation of the order placed by the buyer, or to dissolve the agreement without judicial intervention, by notifying the buyer in writing and without Apollanja Shopping being liable for any damages, unless under the circumstances it would be unacceptable by the standards of reasonableness and fairness.

8.2 Force majeure means that Apollanja Shopping is not liable for any damages whatsoever.

8.2 Force majeure shall mean any failure not attributable to Apollanja Shopping as: for example, technical / provider problems or errors by third parties such as carriers or credit card companies. This because Apollanja Shopping can not be blamed and neither by law, legal act or generally accepted for its account. Apollanja Shopping can not be blamed for any failure.

Article 9. Intellectual and industrial property rights

9.1 Buyer must fully and unconditionally respect all intellectual and industrial property rights such as, for example, copyright which, rests on the products supplied by Apollanja Shopping.

9.2 Apollanja Shopping must respect all intellectual and industrial property rights.

9.2 Apollanja Shopping does not guarantee that the products supplied to purchaser do not infringe any (unwritten) intellectual and/or industrial property rights of third parties.

Article 10. Privacy/Security

10.1 Apollanja Shopping respects the privacy of all buyers. Apollanja Shopping uses buyer data solely for the purpose of handling the order. All buyer data is stored and processed by us in compliance with the provisions of the AVG Act. Please refer to our privacy statement.

10.2 All your personal data can be requested, corrected, withdrawn or deleted free of charge at any time.

10.3 Apollanja Shopping does not pass on buyer data, including address and email address, to third parties without the explicit consent of the buyer. The buyer may revoke this consent at any time. Excluded from this are the companies engaged by Apollanja Shopping for the execution of orders and which require certain data for the processing of the order (such as the freight forwarder who carries out the delivery and the credit institution that takes care of handling the payment). In these cases, however, only the minimum necessary data is transmitted.

Article 11. Miscellaneous

11.1 Where departures from these Terms and Conditions have been permitted by Apollanja Shopping for a short or long period of time, tacitly or otherwise, this does not affect its right to demand direct and strict compliance with these Terms and Conditions. Buyer may never assert any right on the grounds that Apollanja Shopping applies these Terms and Conditions leniently.

11.2 If one or more of the provisions of these Terms and Conditions or any other agreement with Apollanja Shopping should be contrary to any applicable legal provision, the provision in question will cease to have effect and will be replaced by a new legally permissible similar provision to be determined by Apollanja Shopping.

11.3 Apollanja Shopping will not be liable for any loss or damage caused by any violation of these Terms and Conditions.

11.3 Apollanja Shopping is authorized to make use of third parties in the execution of order(s) placed by the purchaser.

Article 12. Liability

12.1 Apollanja Shopping websites are intended to provide information to our buyer. We have compiled the content of this site with the utmost care, but cannot make any guarantees regarding the nature or content of the information on this site. We are not liable for the content of this information or for the consequences of its use.

12.2 Reviews posted on this site reflect solely the personal opinion of the respective contributor. We are in no way responsible for the content of these reviews.

Article 13. Disputes and Complaints

13.1 All rights, obligations, offers, orders and agreements to which these Conditions apply, as well as these Conditions, are exclusively governed by Dutch law. Even if the Buyer is resident abroad. The Vienna Sales Convention does not apply.

13.2 Complaints about the execution of the agreement must be submitted within 7 days fully and clearly described to Apollanja Shopping, after the Buyer has found the defects.

13.3 Complaints submitted to Apollanja Shopping will be answered within a period of 14 days from the date of receipt. If a complaint requires a foreseeably longer processing time, Apollanja Shopping will respond within the 14-day period with a notice of receipt and an indication of when the Buyer can expect a more detailed answer.

13.4 If the complaint cannot be resolved by mutual agreement, a dispute arises that is subject to the dispute settlement.

13.5 In case of complaints, the buyer should first turn to Apollanja Shopping. Apollanja Shopping is a webshop affiliated with Webstore Quality Foundation and complaints that can not be resolved by mutual agreement, the Buyer should turn to WebwinkelKeur Foundation (www.webwinkelkeur.nl), which will mediate free of charge. If there is still no solution, the Buyer has the possibility to have his complaint handled by the independent arbitration board appointed by Stichting WebwinkelKeur, the decision is binding and both entrepreneur and consumer agree to this binding decision. There are costs associated with submitting a dispute to this dispute committee, which have to be paid by the Buyer to the committee concerned. It is also possible to submit complaints via the European ODR platform (http://ec.europa.eu/odr).

13.6 A complaint does not suspend Apollanja Shopping's obligations, unless Apollanja Shopping indicates otherwise in writing.

13.7 If a complaint is found valid by Apollanja Shopping, Apollanja Shopping will, at its option, either replace or repair the delivered products free of charge.

Article 14. Copyrights

This site enjoys copyright protection. This site is intended for the personal or internal use of our visitors, which site may not be reproduced or published other than by downloading and viewing it on a single computer, and/or printing a single hardcopy. Without prior written permission from Apollanja Shopping, it is not permitted to otherwise reproduce, transmit or make this site available on a network.

Article 15. Trademarks

Framing our sites is not permitted. We do not consider ourselves responsible or liable for access to or information on any site connected/linked from or to this site.

Article 16. Warranty and Liability

16.1 Apollanja Shopping guarantees that the goods to be supplied meet the usual requirements and standards that can be set for them and are free from any defects whatsoever.

16.2 The proof of purchase serves as proof regarding the warranty.

16.3 Apollanja Shopping shall never be liable to pay any compensation to the Buyer or others, unless there is intent or gross negligence on the part of Apollanja Shopping. Apollanja Shopping shall never be liable for consequential or trading loss, indirect damage and loss of sales.

16.5 If, for any reason, Apollanja Shopping is bound to compensate any damage, the compensation will never exceed an amount equal to the invoice value for the product or service that caused the damage.

16.6 Notwithstanding the provisions of this article, there can be no warranty if wear and tear can be considered normal and further in the following cases:

- if changes have been made in or to the product, including repairs not made with the permission of Apollanja Shopping or the manufacturer; - if the original invoice cannot be presented, has been altered or has been made illegible;

- if defects resulting from improper or inappropriate use;

- if damage was caused by intent, gross negligence or carelessness.

16.8 The Buyer is bound to indemnify Apollanja Shopping against any claims that third parties may assert against Apollanja Shopping in connection with the agreement, insofar as the law does not prevent the relevant damages and costs from being borne by the Buyer.

The Buyer is obliged to return the product to Apollanja Shopping in order to ensure a proper assessment and settlement of the warranty claim. If a complaint is declared founded, Apollanja Shopping undertakes to supply an equivalent product unless otherwise agreed.

16.9 In addition to these warranty provisions, legal warranty provisions remain in force.

Any arrangement offered by the company as a warranty does not affect the rights that the consumer may assert against the company under the law and the distance contract.

A warranty, if any, provided by the manufacturer or importer does not affect the rights the consumer may assert against the company under the law, the distance contract and the warranty provided by the company.

Article 17 Disclaimer
